United States Bankruptcy Courtsare courts created under Article I of the United States Constitution to help people who can no longer pay their debts. There are different types of bankruptcies, which are usually referred to by their chapter in the U.S. Bankruptcy Code.

  • Chapter 13, Repayment Plan or a Wage Earner’s Plan is for individuals with regular income to develop a plan to repay some or all of their debts. Chapter 13 offers individuals an opportunity to save their home from foreclosure, stop repossession, recovering vehicles that have already been reposed, stopping garnishments, and dealing with delinquent taxes.
  • Chapter 7 or liquidation is for individuals, businesses, corporations, partnerships, LLCs, and other business entities to seek relief from debt. In a Chapter 7 bankruptcy, the individual is allowed to keep certain exempt property; however, most liens(such as real estate mortgages and security interests for car loans) survive. Any non-exempt assets are sold (liquidated) by the trustee repay creditors.
